What is a Development Application?

A Development Application (DA) is the standard planning approval pathway for building and development projects in NSW.

When your project does not meet the requirements for the fast-track Complying Development Certificate (CDC) pathway, a DA is the route you will need to take. The application is lodged with your local council, who will assess your proposal against NSW planning legislation and local development controls before making a determination.

The DA process involves more steps and typically takes longer than a CDC, but it allows council to consider a broader range of projects — including those with site constraints, heritage considerations, or non-standard designs that fall outside the strict CDC eligibility criteria.

What Does a DA Involve?

Every DA is different, but most applications include a combination of the following:

  • Standard application forms

  • Architectural and site plans

  • A Statement of Environmental Effects (SEE) — a document that explains what you are proposing and how any potential impacts will be managed

  • Specialist studies and technical reports, where required (such as bushfire, flood, traffic, or heritage assessments)

The level of documentation required will vary depending on the size and nature of your project, the zoning of your land, and the specific requirements of your local council. What is needed for a small residential addition in one council area may be quite different from what is required in another.

Why Is a DA Sometimes Necessary?

Not every project can take the CDC pathway. A DA may be required when:

  • Your property or project does not meet the SEPP Code (State Legislation) requirements for CDC

  • Your land is in a heritage conservation area or is individually heritage listed

  • Your project is complex, large-scale, or involves a change of land use

  • Your council has specific local planning controls that need to be considered

A DA gives council the opportunity to assess your project on its individual merits, which can work in your favour for projects that might not fit neatly within standard rules.

Every Project Still Needs a Construction Certificate and Occupation Certificate

A DA is planning approval only — it confirms that what you are proposing is acceptable in principle. Before construction can begin, you will also need a Construction Certificate (CC) to confirm that your building plans meet the relevant construction standards. And once construction is complete, an Occupation Certificate (OC) is required before the building can be used or occupied.
